Frequently Asked Questions

Do I need a prenup?

A prenuptial agreement is not a legal requirement in the UK but it is a sensible way to protect your assets before marriage. Speaking to a prenup solicitor is the best way to understand whether a prenuptial agreement is right for your circumstances. It is particularly worth considering if you own property, have significant savings, run a business or have children from a previous relationship.

How long does a prenup take?

A prenuptial agreement typically takes 2 to 4 weeks to complete. At Prenup Solicitors we aim to have your prenuptial agreement signed within 2 weeks. However we recommend starting the process at least 3 months before your wedding date to allow sufficient time for drafting, negotiation, financial disclosure and signing.

Is a prenup legally binding in the UK?

Prenuptial agreements are not automatically legally binding in England and Wales but courts give them significant weight if certain conditions are met. Both parties must have received independent legal advice from a qualified prenup solicitor, made full financial disclosure and signed the agreement freely and without pressure.

What happens if I don’t have a prenup?

Without a prenuptial agreement a court will decide how your assets are divided if you separate. This can be unpredictable and costly. A prenup gives you and your partner control over what happens to your assets and can save significant time, money and stress in the future.
